Information on introduction of Extension of Time Applications and Non Material Amendments
New legislation was introduced in October 2009 to allow certain permissions to be extended for a temporary period in the current economic climate and to allow for Non-Material Amendments. The fees were subject to separate legislation which was passed on 26 February 2010.
Extension of Time applications
The main criteria are set out below, but please contact Development Management to check if your renewal qualifies for this process:-
- Application must still be 'live' i.e. within the time condition on the Decision Notice
- Work must not have started on site
- Original decision must have been made before 1 October 2009.
- It can only be used for a Listed Building Consent or Conservation Area Consent where a concurrent Planning Permission is also being extended.
- It cannot be used to extend a reserved matters permission (the original outline permission would have to be extended instead)
The fees are as follows:-
Householder Application - £50
Major Application - £500
Other Applications - £170
Non Material Amendments
Non-Material Amendments can be made to an approved Planning Permission (but not to Listed Building Consents of Conservation Area Consents). There is no standard definition of a Non-Material Amendment as it depends on the circumstances of each case and you are therefore advised to contact Planning Services to find out if your request can be treated as a Non-Material Amendment application or if a new planning application is required. Please note that applications for a Non-Material Amendment may be approved or refused and must be made on the appropriate application form (not by letter) and accompanied by the following fee:-
Householder amendment - £25
Other amendments - £170
