4. Court action
Courts will begin to deal with evictions from the 20th September 2020.
If you were served a possession order, or warrant of eviction, by the court before 3 August 2020 these have been adjourned due to the pandemic. Your landlord will therefore be required to submit a Reactivation Notice. This notice must show:
- that the landlord wishes the case to be listed, relisted, heard, or referred and
- any consideration the landlord has given to the tenant and any dependent children, due to effect of the pandemic
In instances where there are rent arrears, the landlord must also provide a 2 year rent statement.
The courts will give you 21 days notice of a new hearing.
