1. How to apply for a review of a premises licence
If you are having problems with a licensed premises, you should first try to sort out the problem informally with the licence holder or report the problem to the Licensing section in order that they can contact the licence holder to give them a chance to put things right.
If this is not successful you will need to build your case. You should keep a diary of incidents such as noise or anti social behaviour etc which can serve as evidence.
Applying for a review
Representations must be based around one or more of the four licensing objectives. These are:
- the prevention of crime and disorder
- public safety
- the prevention of public nuisance
- the protection of children from harm
Representations will be refused if they are deemed to be frivolous, vexatious or repetitious.
To start the review procedure you must submit the correct form to us and, on the same day, give a copy to the premises licence holder/club premises certificate holder and to each Responsible Authority. If you have any queries, please contact us.
If an application for a review is accepted then a hearing must be heard before members of the Licensing sub committee who may:
- decide that no action is necessary
- modify or add conditions to the licence
- exclude a licensable activity from the licence
- remove the designated premises supervisor (DPS)
- suspend the licence for a period (not exceeding three months)
- revoke the licence
We will normally let you have a decision on the day, this will be followed up in writing.
